Accommodation Terms and Conditions

Article 1(Scope of Application)

  1. Accommodation contracts and related agreements concluded between this accommodation facility and guests shall be subject to the provisions of these terms and conditions, and any matters not provided for in these terms and conditions shall be governed by laws and regulations or generally established practices.
  2. In the event that the accommodation facility enters into a special agreement to the extent that it does not violate laws, regulations, or customs, the special agreement shall take precedence over the provisions of the preceding paragraph.

Article 2(Application for Accommodation Contract)

  1. A person who intends to apply for an accommodation contract with this accommodation facility must provide the accommodation facility with the following particulars at the time of application.
    (1) Name of guest
    (2) Date of stay and estimated time of arrival
    (3) Accommodation fees (in principle, based on the basic accommodation fees set forth in Schedule 1).
    (4) Any other matters deemed necessary by the Accommodation Facility.
  2. If a guest requests, during their stay, to extend their stay beyond the date specified in item 2 of the preceding paragraph, the accommodation facility will treat this request as if it were an application for a new accommodation contract at the time the request was made.

Article 3(Conclusion of Accommodation Contracts, etc.)

  1. An accommodation contract shall be deemed to have been concluded when the accommodation facility accepts the application stipulated in the preceding article. However, this shall not apply if the accommodation facility proves that it did not accept the application.
  2. When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, the guest shall pay to the accommodation facility an application fee set by the accommodation facility, up to the basic accommodation fee (see Schedule 1) for the period of stay (for three days if it exceeds three days), by the date specified by the accommodation facility.
  3. The application fee will first be applied to the accommodation fee to be paid by the guest in full, and in the event that a situation arises in which the provisions of Articles 6 and 18 apply, it will be applied to the penalty fee and then to compensation, in that order, and the remaining balance, if any, will be refunded at the time of payment of the accommodation fee, etc. in accordance with the provisions of Article 12.
  4. If the application fee set forth in paragraph 2 is not paid by the date specified by the accommodation facility pursuant to the provisions of the same paragraph, the accommodation contract will become invalid. However, this shall only apply if the accommodation facility has so notified the guest when specifying the due date for payment of the application fee.

Article 4(Special agreement waiving the application fee)

  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Accommodation Facility may enter into a special agreement stipulating that the application fee stipulated in the same Paragraph shall not be required to be paid after the Contract has been concluded.
  2. If, at the time of accepting an application for an accommodation contract from a guest, the accommodation facility has not requested payment of the application fee as stipulated in Paragraph 2 of the preceding Article, or if the accommodation facility has notified the guest of the payment of the application fee but has not specified a due date for the payment of the application fee, the accommodation facility shall be treated as having accepted a special contract as stipulated in the preceding Paragraph.

Article 5(Refusal to conclude an accommodation contract)

  1. This accommodation facility may not accept the conclusion of an accommodation contract in the following cases:
    1. When the application for accommodation does not comply with these terms and conditions.
    2. When the Hotel is fully booked and there are no rooms available.
    3. When the Guest seeking accommodation is deemed liable to conduct himself or herself in a manner that will violate the laws, public order or good morals in regard to his or her accommodation.
    4. When the person seeking accommodation is deemed to fall under any of the following items (a) to (c):
      (a) An organized crime group as defined in Article 2, Paragraph 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as an "organized crime group"), an organized crime group member as defined in Article 2, Paragraph 6 of the same Act (hereinafter referred to as an "organized crime group member"), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
      (b) A corporation or other organization whose business activities are controlled by an organized crime group or an organized crime group member.
      (c) A corporation in which any of its officers is a member of an organized crime group.
    5. When the person seeking accommodation behaves in a manner that causes significant inconvenience to other guests.
    6. When the person seeking accommodation can be clearly detected as carrying an infectious disease.
    7. When violent demands are made regarding the accommodation or an unreasonable burden is requested.
    8. When it is impossible to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable reasons.
    9. When the circumstances fall under the provisions of the prefectural ordinance of the location of the accommodation facility as a reason for refusing accommodation pursuant to Article 5, Paragraph 3 of the Inns and Hotels Act.

Article 6(Guest's Right to Cancel Accommodation Contract)

  1. The guest may cancel the accommodation contract by notifying the accommodation facility.
  2. In the event that a guest cancels the accommodation contract in whole or in part due to reasons attributable to the guest (except in the event that the accommodation contract has been cancelled prior to payment when the accommodation contract has been specified by the accommodation contract stipulated in Article 3, Paragraph 2), the accommodation contract shall charge a penalty as listed in Schedule 2. However, in the event that the accommodation contract has entered into a special agreement as stipulated in Article 4, Paragraph 1, this shall only apply if the accommodation contract has notified the guest of the obligation to pay a penalty in the event that the guest cancels the accommodation contract, in accordance with the special agreement.
  3. If the guest does not arrive by 8:00 p.m. on the day of the stay without contacting the accommodation facility (or by two hours after the expected arrival time if the guest has specified that time in advance), the accommodation facility may consider the accommodation contract to have been cancelled by the guest.

Article 7(Right of the Accommodation Facility to Cancel the Contract)

  1. This accommodation facility may cancel the accommodation contract in the following cases.
    1. When the Guest is deemed liable to conduct himself or herself in a manner that will violate the laws, public order or good morals in regard to his or her accommodation, or when it is deemed that he or she has already conducted himself or herself in such a manner.
    2. When the Guest is deemed to fall under any of the following items (a) to (c):
      (a) Organized crime groups, members of organized crime groups, associate members of organized crime groups or persons related to organized crime groups or other anti-social forces
      (b) A corporation or other organization whose business activities are controlled by an organized crime group or an organized crime group member.
      (c) A corporation in which any of its officers is a member of an organized crime group.
    3. When the guest behaves in a manner that causes significant inconvenience to other guests.
    4. When the Guest can be clearly detected as carrying an infectious disease.
    5. When violent demands are made regarding the accommodation or an unreasonable burden is requested.
    6. When it is impossible to provide accommodation due to a natural disaster or other force majeure event.
    7. When the circumstances fall under the provisions of the prefectural ordinance of the location of the accommodation facility as a reason for refusing accommodation pursuant to Article 5, Paragraph 3 of the Inns and Hotels Act.
    8. When the Guest smokes in bed, tampers with fire-fighting equipment, etc., or fails to comply with other prohibited actions in the usage regulations stipulated by the Accommodation Facility (limited to those necessary for fire prevention).

Article 8(Accommodation Registration)

  1. The Guest shall register the following particulars at the front desk of the Accommodation Facility on the day of accommodation:
    1. Name, age, sex, address and occupation of the guest
    2. For foreigners, nationality, passport number, place of entry and date of entry
    3. Departure date and scheduled time
    4. Other matters deemed necessary by the accommodation facility
  2. If a Guest intends to pay the Accommodation Charges, etc. stipulated in Article 12 by traveller's cheques, accommodation vouchers, credit card or other means other than Japanese currency, these shall be presented in advance at the time of registration as stipulated in the preceding paragraph.

Article 9(Guest Room Occupancy Hours)

  1. The hours during which guests may use the guest rooms of this accommodation facility shall be determined separately for each accommodation facility and accommodation plan. However, in the case of consecutive stays, guests may use the guest rooms all day, except on the days of arrival and departure.
  2. Notwithstanding the provisions of the preceding paragraph, if a guest requests to use the room outside of the hours specified in the same paragraph, the accommodation facility may accommodate the request. In this case, the following additional fees will be charged.
    1. If you use the room until 1:00 PM, 20% of the room rate will be charged.
    2. If you use the room until 3:00 PM, 50% of the room rate will be charged.
    3. If you use the room until 6:00 PM, 100% of the room rate will be charged.

Article 10(Compliance with Terms of Use)

Guests are required to abide by the rules of use established by the accommodation facility and posted within the facility.

Article 11(Business Hours)

  1. The opening hours of the front desk and other facilities at this accommodation facility are as follows. Detailed opening hours of other facilities will be provided in the pamphlets provided, on notices posted in various locations, and in the service directory in the guest rooms.

    C Exchange service: None
  2. The hours set out in the preceding paragraph may be subject to temporary change due to unavoidable circumstances. In such cases, we will notify you by appropriate means.

Article 12(Payment of Fees)

  1. The breakdown of the accommodation fees, etc. to be paid by the guest shall be as set forth in Schedule 1.
  2. Payment of the accommodation fees, etc. set forth in the preceding paragraph shall be made at the front desk at the time of departure of the guest or upon request by the accommodation facility in currency or by any other means acceptable to the accommodation facility, such as traveler's checks, accommodation vouchers, or credit cards.
  3. Accommodation charges will be charged even if the guest voluntarily does not stay in the accommodation after the accommodation facility has provided the guest with a room and made it available for use.

Article 13(Responsibilities of the Accommodation Facility)

  1. This accommodation facility will compensate the guest for damages caused to the guest in the fulfillment or non-fulfillment of the accommodation contract and related agreements, unless such damages are due to reasons not attributable to this accommodation facility.
  2. Our accommodation facility is covered by hotel liability insurance to deal with the unlikely event of a fire or other disaster.

Article 14 (Handling when contracted rooms cannot be provided)

  1. When the accommodation facility is unable to provide the guest with the contracted room, it will arrange accommodation of the same standard elsewhere for the guest, with the guest's consent, as far as possible.
  2. Notwithstanding the provisions of the preceding paragraph, if the accommodation facility is unable to arrange other accommodation for the guest, the accommodation facility will pay the guest a compensation fee equivalent to the penalty charge, which will be used to cover damages. However, if the accommodation facility is unable to provide a room due to reasons not attributable to the accommodation facility, the accommodation facility will not pay a compensation fee.

Article 15 (Handling of Deposited Items, etc.)

  1. In the event that loss, breakage or other damage occurs to goods, cash or valuables deposited by the guest at the front desk, the accommodation will compensate for such damage, unless it is due to force majeure. However, in the case of cash and valuables, if the accommodation requests a declaration of their type and value and the guest fails to do so, the accommodation will compensate for such damage up to a maximum of 150,000 yen.
  2. If the loss, breakage or other damage occurs due to the intentional or negligent act of the accommodation facility to goods, cash or valuables brought into the accommodation facility by the guest but not deposited at the front desk, the accommodation facility will compensate for such damage. However, for items for which the guest has not previously specified the type and value, the accommodation facility will compensate for such damage up to a maximum of 150,000 yen, except in cases where the loss or damage is due to the intentional or gross negligence of the accommodation facility.

Article 16 (Custody of Guest's Baggage or Belongings)

  1. If the baggage of the Guest is delivered to the Accommodation before the Guest's arrival, the Accommodation shall be responsible for storing it only if the Accommodation has agreed to this in advance and shall hand it over to the Guest at the front desk when the Guest checks in.
  2. If a guest leaves their baggage or belongings behind at the accommodation after checking out, the accommodation will store said baggage or belongings for seven days, including the day they are found. If the owner contacts the accommodation within seven days, including the day they are found, the accommodation will ask the owner for instructions. However, if the owner does not give instructions or if the accommodation does not contact the accommodation within seven days, including the day they are found, after storing the baggage or belongings as described above, the accommodation will turn over cash and valuables to the nearest police station and dispose of other baggage or belongings. Regardless of the above, food, drink, and magazines will be disposed of on the same day.
  3. The responsibility of the accommodation facility regarding the custody of the guest's baggage or belongings in the cases of the preceding two paragraphs shall be in accordance with the provisions of paragraph 1 of the preceding article in the case of paragraph 1, and in accordance with the provisions of paragraph 2 of the same article in the case of the preceding paragraph.

Article 17 (Parking Responsibility)

When a guest uses the parking lot of this accommodation facility, regardless of whether the key to the vehicle is deposited with the guest, this accommodation facility is merely lending the space and is not responsible for the management of the vehicle. However, if damage is caused intentionally or negligently by the accommodation facility in managing the parking lot, the accommodation facility will be liable for compensation.

Article 18 (Guest Liability)

If the accommodation facility suffers damage due to the guest's willful misconduct or negligence, the guest shall compensate the accommodation facility for the damage.

Appendix 1: Breakdown of Accommodation Charges, etc. (related to Article 2, Paragraph 1, Article 3, Paragraph 2, and Article 12, Paragraph 1)

  1. The basic accommodation fee is based on the price list posted at the front desk or on the website.
  2. When an Accommodation Contract is concluded after the Accommodation Facility has notified the Guest of a basic accommodation fee that differs from the fee schedule posted at the front desk or on its website, the basic accommodation fee shall be in accordance with the notified fee.
  3. Children's rates are charged at a rate determined separately for each accommodation facility. Children's rates apply to guests within the range determined separately for each accommodation facility.

Schedule 2 Penalty Charges (related to Article 6, Paragraph 2)

  1. The percentage is the ratio of the penalty to the basic accommodation fee.
  2. If the number of days of the contract is shortened, a penalty for one day (the first day) will be charged regardless of the number of days shortened.
  3. If a contract is terminated for part of a group of 15 or more people, no penalty will be charged for the number of people that is 10% (rounded up to the nearest whole number) of the number of guests staying as of 10 days prior to the date of stay (or the date of acceptance if the application is accepted after that date).
  4. With regard to the obligation to pay penalties when a Guest cancels an Accommodation Contract, if the Accommodation has notified the Guest of terms and conditions different from these terms and conditions at the time of applying for the Accommodation Contract, the terms and conditions will take precedence.
  5. (*) During special periods designated by our company (Golden Week, around Obon in August, and the New Year holidays), a 20% penalty will be charged from two weeks prior to the reservation. Special periods are those designated on the website of our accommodation facilities.
